Terms of Service

These Terms of Service (“Terms”) govern your use of Scribbly’s websites, customization tools, previews, products, subscriptions, and related services (collectively, the “Services”).

The Services are operated by Scribbly Inc. (“Scribbly,” “we,” “us,” or “our”). By accessing the Services, creating a personalized product, placing an order, or enrolling in a subscription, you agree to these Terms and our Privacy Policy and Returns & Refunds Policy.

If you do not agree to these Terms, please do not use the Services.

1. Eligibility

You must be at least 18 years old and legally able to enter into a binding agreement to place an order or create an account.

Our products may be created for children, but the Services are intended for use by adults. Children should not upload photographs, provide personal information, or place orders themselves.

2. Personalized products and previews

Scribbly creates custom-made products using information and materials you provide, which may include names, photographs, physical characteristics, interests, memories, team information, jersey numbers, written messages, and other personalization details.

You will receive an opportunity to preview your personalized product before ordering. You are responsible for carefully reviewing the preview, including:

  • Names and spelling

  • Personalization details

  • Selected characteristics and options

  • Written messages and dedications

  • Artwork and overall design

By placing your order, you confirm that you have reviewed and approved the preview and authorize Scribbly to produce the product shown.

Because our artwork is stylized, illustrated, and created through a combination of artistic and technological processes, we do not guarantee an exact photographic likeness. Minor differences between a digital preview and the printed product—including differences in color, brightness, cropping, positioning, or print finish—may occur.

3. Customer-provided content

You retain ownership of the photographs, text, and other materials you submit to Scribbly (“Customer Content”).

By submitting Customer Content, you grant Scribbly and its service providers a limited, nonexclusive license to use, reproduce, modify, process, and transmit that content only as reasonably necessary to:

  • Create your preview and personalized product

  • Produce and fulfill your order

  • Provide customer support

  • Operate, secure, and improve the Services

  • Comply with applicable law

This license does not give Scribbly permission to use your child’s photograph, name, or finished product in public advertising or marketing. We will obtain separate permission before using identifiable Customer Content for those purposes.

You represent and warrant that:

  • You own the Customer Content or have permission to use and submit it;

  • You are the parent or legal guardian of any child depicted, or you have authorization from the child’s parent or legal guardian;

  • Your submission and our authorized use of it will not violate another person’s privacy, publicity, copyright, trademark, or other rights; and

  • The information you provide is accurate and lawful.

You may not submit content that is unlawful, abusive, threatening, hateful, sexually explicit, exploitative, deceptive, or otherwise inappropriate. We may refuse or cancel an order containing prohibited content.

4. Orders and payment

Prices, product details, available options, taxes, shipping charges, and other fees are shown during checkout. By submitting an order, you authorize us and our payment processor to charge the payment method provided for the total displayed at checkout.

An order confirmation means we have received your order. It does not require us to accept or fulfill an order if:

  • Payment cannot be processed;

  • The product or selected option is unavailable;

  • The order contains prohibited or potentially infringing content;

  • Pricing or product information contains an obvious error; or

  • We reasonably suspect fraud, misuse, or unlawful activity.

If we cancel an order before production, we will refund the amount paid for the canceled item.

We may correct typographical, pricing, or product-description errors. If a correction materially affects an order you have already placed, we will contact you before proceeding whenever reasonably possible.

5. Printing, cancellations, returns, and refunds

Each Scribbly product is personalized and made specifically for its recipient.

You may cancel an order for a full refund before it is sent to print. Once an order has been sent to print, it can no longer be changed, canceled, returned, or refunded because it cannot be restocked or resold.

If an item arrives damaged, contains a printing or manufacturing defect, or is materially different from the preview you approved, contact us as soon as possible with your order number, a description of the problem, and clear photographs. We will review the issue and make it right, which may include replacing the affected item or providing another appropriate resolution.

Customer-approved spelling, personalization, selection, or content errors are not considered manufacturing defects.

Our complete Returns & Refunds Policy is incorporated into these Terms.

6. Subscriptions and recurring orders

If you enroll in a Scribbly subscription or Book Club, the price, billing frequency, product frequency, and other material terms will be disclosed before you enroll.

By enrolling, you authorize Scribbly to charge your payment method automatically at the disclosed interval until you cancel. You may cancel using the cancellation method provided through your account, during checkout, or by contacting us.

Cancellation stops future subscription renewals. Any order already charged or sent to production remains subject to our Returns & Refunds Policy. To avoid the next recurring charge, you must cancel before that charge is processed.

If subscription pricing changes, we will provide advance notice before applying the new price to a future renewal. You may cancel before the new price takes effect.

7. Production and delivery

Production and delivery dates are estimates unless we expressly state otherwise. Delivery may be affected by production volume, carrier delays, weather, incorrect addresses, customs processing, or other circumstances outside our reasonable control.

You are responsible for providing a complete and accurate delivery address. If an order is returned or cannot be delivered because of an incorrect address supplied by you, additional production or shipping charges may apply.

Risk of loss passes to you when the order is delivered to the address provided, except where applicable law requires otherwise.

If we cannot ship within the timeframe promised, we will provide any notice, cancellation option, or refund required by applicable law.

International customers are responsible for customs duties, import taxes, brokerage fees, or similar charges unless checkout expressly states that those charges are included.

8. Intellectual property

The Services—including Scribbly’s illustrations, product designs, characters, stories, text, graphics, logos, software, website design, templates, and other original materials—are owned by or licensed to Scribbly and are protected by intellectual-property laws.

Purchasing a Scribbly product gives you ownership of the physical product for personal use. It does not transfer Scribbly’s copyright or other intellectual-property rights.

Unless we provide written permission, you may not:

  • Copy, reproduce, publish, sell, or commercially exploit Scribbly artwork or content;

  • Create merchandise or derivative commercial products from our designs;

  • Remove copyright, trademark, or ownership notices;

  • Scrape, reverse engineer, or interfere with the Services; or

  • Use Scribbly content or customer previews to train an artificial-intelligence or machine-learning system.

You may photograph and share your purchased product for ordinary personal, noncommercial purposes.

9. Acceptable use

You agree not to:

  • Use the Services for an unlawful, fraudulent, or abusive purpose;

  • Submit content that violates another person’s rights;

  • Attempt to access another customer’s account or information;

  • Introduce malware or interfere with the operation or security of the Services;

  • Use automated systems to scrape, overload, or extract data from the Services; or

  • Misrepresent your identity or authority to submit a child’s information or photograph.

We may suspend access, reject content, or cancel an order when we reasonably believe these Terms have been violated.

10. Third-party services

We use third parties to provide services such as payment processing, website hosting, printing, manufacturing, shipping, analytics, and customer support.

Third-party websites and services may be governed by their own terms and privacy policies. Scribbly is not responsible for the independent acts or omissions of third parties, except to the extent required by applicable law.

11. Product and service disclaimer

We work hard to provide accurate previews, descriptions, and high-quality personalized products. However, except for promises expressly stated in these Terms and to the fullest extent permitted by law, the Services are provided “as is” and “as available.”

We do not guarantee that the Services will always be uninterrupted or error-free. We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement to the extent those disclaimers are permitted by law.

Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

12. Limitation of liability

To the fullest extent permitted by law, Scribbly and its directors, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, or loss of business opportunity, arising from your use of the Services or purchase of a product.

To the fullest extent permitted by law, Scribbly’s total liability relating to a particular order will not exceed the amount you paid for that order.

These limitations do not apply where liability cannot legally be limited or excluded.

13. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Scribbly and its directors, officers, employees, contractors, and service providers from third-party claims, damages, or reasonable expenses arising from:

  • Customer Content you submit;

  • Your violation of another person’s rights;

  • Your unlawful misuse of the Services; or

  • Your material violation of these Terms.

This section does not require you to indemnify Scribbly for Scribbly’s own negligence, unlawful conduct, or breach of these Terms.

14. Privacy

Our collection and use of personal information are described in our Privacy Policy.

Because photographs and other information about children require particular care, only a parent, legal guardian, or properly authorized adult may submit that information. Do not submit a child’s information unless you have the authority to do so.

15. Governing law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

Any dispute that cannot be resolved informally will be brought in a court with lawful jurisdiction where Scribbly’s principal place of business is located, unless applicable consumer law gives you the right to bring the dispute elsewhere.

Before filing a claim, you and Scribbly agree to make a reasonable, good-faith effort to resolve the issue directly. Nothing in this section prevents either party from seeking relief in small-claims court when eligible.

16. Changes to these Terms

We may update these Terms to reflect changes to our Services, business practices, or legal obligations.

The updated Terms will be posted with a revised effective date. Material changes will apply prospectively, and we will provide additional notice when required by law. The Terms in effect when you place an order will continue to govern that order unless a change is legally required.

17. Severability and waiver

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.

Our failure to enforce a provision on one occasion does not waive our right to enforce it later.

18. Entire agreement

These Terms, together with our Privacy Policy, Returns & Refunds Policy, and any terms presented during checkout, constitute the agreement between you and Scribbly concerning the Services.

If checkout terms conflict with these Terms regarding a particular product, price, subscription, or promotion, the more specific checkout terms will control for that transaction.
